These Terms and Conditions (“Terms”) govern the Payment Gateway Services used by DOUBLE TREE BY STAR LLP (KINGDOME) (“Client”) through the Bank and its authorized Payment Gateway Service Provider. By accessing or using the Payment Gateway Services, you (“Customer” or “User”) agree to these Terms.

1. Definitions

• Client: Refers to DOUBLE TREE BY STAR LLP (KINGDOME).
• Customer: An end-user making online payments on KINGDOME’s platforms.
• E-Commerce Platform: KINGDOME’s official online platforms for events, reservations, memberships, F&B purchases, or other services.
• Payment Gateway Services: Includes all digital payment options such as Card Payments, UPI, Net Banking, Wallets, IMPS, and any other modes enabled by the Bank/Service Provider.
• Customer Charge: The total payable amount, including GST and applicable fees.
• Chargeback: A payment dispute raised by the Customer, leading to reversal of the Transaction.
• Transaction: Any online order or payment processed via the Payment Gateway.
• Other Terms: Additional guidelines or policies issued by the Bank/Service Provider.

2. Representations: KINGDOME confirms that it is legally authorized to operate hospitality and entertainment services, and has the full right to integrate and use the Payment Gateway Services.

3. Obligations of KINGDOME

• Ensure a secure online platform for transactions
• Maintain transparency in pricing and service details
• Fulfill services on time
• Follow applicable laws & regulations
• Use the designated settlement bank account
• Prevent fraudulent or unauthorized transactions

4. Payments & Settlement

• Settlement will follow the timelines defined by the Bank/Service Provider.
• Applicable charges, MDR, and fees may be deducted.
• Adjustments apply for chargebacks, refunds, or disputes.

5. Chargeback Handling

• Submit supporting documents within timelines.
• Maintain records of all transactions.
• Bear liability for unresolved chargebacks.

6. Intellectual Property: Each party retains ownership of its trademarks and proprietary materials. No trademark usage is allowed without authorization.

7. Indemnity: KINGDOME agrees to indemnify the Bank/Service Provider against losses arising from disputes, fraud, misrepresentation, or violations.

8. Confidentiality: Confidential information must be safeguarded and not disclosed unless legally required.

9. Term & Termination : These Terms begin on activation and may be terminated with proper notice.

10. Governing Law Jurisdiction: Mumbai, India.

11. Force Majeure: No liability for delays due to events beyond control.

12. Right to Hold Settlement: The Bank/Service Provider may withhold settlements for suspected fraud, chargeback risk, or regulatory reasons.

13. Additional Requirements

• Checkout page compliance
• Customer communication standards
• Fraud control systems
• Timely updates to the Bank

14. American Express & ICICI Merchant Services: Compliance with additional rules and policies is required.

Acceptance
By using the Payment Gateway Services, DOUBLE TREE BY STAR LLP (KINGDOME) agrees to these Terms & Conditions.
